Return and Refund Policy:


All new and unopened products come with a 30-day, money-back guarantee based on the delivery date as provided by the shipper, except for specific product guarantees as advertised on the specific deltacart.com product pages and official Delta Cart marketing messaging distributed directly by Delta Cart. Exchange Policy:


If any products arrive damaged or broken, or part of your order is missing, you must notify the Company within 3 days of delivery. If you receive a delivery notification from Delta Cart and you believe your order was not delivered, you must notify the company in 7 days or you forfeit the ability to request a replacement.

Shipping Policy:


  • Shipping Options- Delta Cart has partnerships with multiple carriers including FedEx, UPS and USPS Priority to best serve our customers. Depending on the location of the shipment, Delta Cart will select the best and fastest possible shipping service for your location. (PO BOX delivery addresses will ship with USPS Priority). If offered on the website, customers may upgrade delivery service to Overnight for a fee. In those instances, Delta Cart will ship out with either FedEx or UPS.

  • Packaging- corrugated boxes, bubble mailers, die-cut mailer, pack mailers, bubble wrap, feeder paper. During summer months and when orders contain heat sensitive items, the delivery package may contain foil insulations and a gel ice pack.

  • Processing timeframe: 2-3 business days from time payment is processed.

Resale:


You agree not to resell any Delta Cart products on any on-line marketplace site, such as Amazon or Groupon.


Arbitration:


Any controversy or claim arising out of or relating to your purchase or these terms and conditions, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.


DELTA CART REWARDS PROGRAM TERMS AND CONDITIONS


PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE PARTICIPATING IN THE DELTA CART REWARDS PROGRAM.

The Delta Cart Rewards Program (“Program”) is brought to you by Delta Cart, and benefits shall be considered void where prohibited by law. By participating in the Program, you consent to the Program terms and conditions set out below. Taxes may apply where required by law. Delta Cart assumes no liability for any user’s participation that contravenes the laws or regulations of his or her place of residence. Participation is subject to present and future program rules. Participation is valid only on deltacart.com and program rewards (“Points”) may only be earned and redeemed on deltacart.com (“website”).

No purchase is necessary to join in the Program. All users who sign up for a customer account at deltacart.com with a valid username and password, except for those users who are part of the Delta Cart Corporate Partnership Program, are automatically enrolled in the Program and can begin earning and redeeming Points according to the rules of the program. Guest users are not automatically enrolled in the program and will not earn points for purchases.

Delta Cart specifically reserves the right to terminate, cancel, suspend and/or modify the Program, or any specific user’s participation in the Program, at any time in its sole discretion. In addition, Delta Cart reserves the right, in its sole and absolute discretion, to terminate, cancel, suspend and/or permanently ban any specific user’s participation in the Program if Delta Cart suspects that such user is conducting fraudulent activity to acquire, accumulate or spend Points including, but not limited to, by a user creating multiple Program accounts, false referrals, etc.


Eligibility; Privacy


The Program is offered only in the United States to individuals who are: (a) over 18 years of age as of the date of their first participation in the Program; and (b) legal US residents. When registering for the Program you agree to register only one (1) account for the purpose of accruing or earning Points. You must provide information accurately and completely when creating an account. The information you provide will be handled in accordance with the www.deltacart.com privacy policy available at https://deltacart.com/privacy-policy.

Delta Cart reserves the right to refuse membership to any customer who does not follow the enrollment procedures. You should promptly advise Delta Cart of any changes to your personal account contact information, such as name, address, telephone number(s) and/or email address, by logging into deltacart.com and updating your account.


Earning Points


You must be logged into your deltacart.com account to earn points. You will earn 50 Points upon registering for an account on www.deltacart.com.

Registered users subsequently earn 1 Point for every $1 spent on deltacart.com. Points are earned based on the amount actually spent on deltacart.com products, not on the amounts of any discounts, account credits, taxes or shipping. If an order is cancelled, Points awarded for the purchase will be cancelled.

Registered users can also earn additional points from time to time by taking actions prescribed on https://deltacart.com/rewards-program.

Registered users who refer a new customer to deltacart.com can earn a $20 coupon credit for each successful new customer referral. To qualify, the referred person must (1) place an order on deltacart.com that meets the stated minimum threshold (currently set at $40) with their first purchase and (2) also be a new customer on the website. Customers may not refer anyone who has an existing www.deltacart.com account under an alternate email address or a variation of their name.

From time to time, Delta Cart may amend the requirements for earning or redeeming Points, without notice to users. You will be able to check the amount of Points accumulated in your account by logging in to your account and viewing the Program account page.

You may not redeem or exchange accumulated Points for cash. Points have no cash value and do not constitute property of the user. You may not give, donate, transfer or share your Points to another user’s account.


Expiration of Points


The Program is a benefit provided to regular customers of Delta Cart. For accounts to stay in good standing and maintain their points balance, the account must complete at least one purchase every six months beginning on the date the account is created. If six months pass without a purchase by an account, the points accrued in that account will be forfeited. In addition, points will automatically expire if a user’s account is revoked or otherwise cancelled in accordance with deltacart.com terms and conditions.


Returns


Merchandise returns must be made in accordance with Delta Carts’ return policy available at deltacart.com. Upon the return of an item, the spend amount applied to Program Level status for the original purchase will be deducted from your account.


Employee Eligibility


All current employees of Delta Cart are ineligible to participate in the Program.

Redeeming Points


Points may be redeemed by logged-in users when making a purchase on deltacart.com. You must login to your account in order to redeem Points. Information about your points account may be viewed on https://deltacart.com/rewards. Points can be redeemed while checking out on the website.

Unless otherwise specified, Points may not be redeemed in conjunction with other discounts or special offers. Delta Cart may limit the number of Points which may be redeemed at one time. Users may redeem only one discount reward per purchase.


Account Termination


Participation in the Program is a privilege granted to deltacart.com users and as such can be suspended, revoked or terminated at any time by Delta Cart for any reason or for no reason. In the event of termination of your participation, all benefits including all accrued Points and other program benefits will automatically and immediately be forfeited. In the event of termination of a user’s participation or a termination of the Program by Delta Cart, Delta Cart has no liability to participants for unused Points or other program benefits.


Account Cancellation


You may cancel your participation in the Program at any time by deleting your deltacart.com customer account. Once cancelled, all Points earned are voided and may not be redeemed on any future purchase. Please contact Customer Service at (754) 227 9477 for assistance in canceling your account.


Limitation of Liability


DELTA CART WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON DELTA CARTS’ LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM DELTA CART AND THAT THIS IS A REASONABLE ALLOCATION OF RISK.


Intellectual Property


All Program design, text, graphics, logos, images, titles, phrases and product names and the copyrights, trademarks, service marks, trade dress and/or other intellectual property in such materials are owned by Delta Cart and may be registered in the United States and internationally.


No Warranty


Delta Cart and each of its subsidiaries and affiliates, along with each such entity’s respective officers, directors, employees, and agents make no warranty, express or implied, including but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to the Program or any products or services related to such Program.


Program Changes


Delta Cart reserves the right to vary any or all of the terms of the Program, to amend these Terms of Service, or to terminate the Program, at any time without notice and without further obligations to users, including, but not limited to, modifications which: a) govern Points earned on and after the date of the change; or b) change the value of already accumulated Points. Notice of any such changes, amendments or termination may be provided to users via email, or by being posted on the deltacart.com website and will be effective immediately, unless otherwise stated in such notification.


Dispute Resolution


These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida and any dispute shall be subject to binding arbitration in Broward County, Florida. If any provision of this Agreement shall be found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.


Class Action Waiver


You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed.

The arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action or private attorney general action) unless all relevant parties specifically agree to do so following initiation of the arbitration. If this Class Action Waiver clause is found to be illegal or unenforceable, this entire Provision will be unenforceable, and the dispute will be decided by a court.


DELTA CARTS’ CORPORATE PARTNER PROGRAM TERMS AND CONDITIONS


PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE PARTICIPATING IN THE DELTA CART CORPORATE PARTNER PROGRAM. BY PARTICIPATING IN THE PROGRAM, YOU AGREE TO THESE TERMS AND CONDITIONS.


Program Participation


Participation in the Delta Cart Corporate Partner Program (DCCPP) is a privilege granted to verified employees of participating companies. Membership of a company or any individual participant is approved at Delta Cart sole discretion and can be suspended, revoked or terminated at any time by Delta Cart for any reason or for no reason. In the event of termination of your or your company’s participation or termination of the DCCPP by Delta Cart, all benefits including all or any accrued Points in the Delta Cart Rewards Program and/or any other DCCPP benefits will automatically and immediately be forfeited and Delta Cart has no liability to participants for unused Points or other DCCPP benefits.


Eligibility; Privacy


The DCCPP is offered only in the United States to individuals who are: (a) over 18 years of age as of the date of their first participation in the DCCPP; (b) legal US residents; and (c) current employees of the member company with a validated email address. You must create an account, and that account must be approved by Delta Cart, in order to participate. When registering for the DCCPP you agree to register only one (1) account. You must provide information accurately and completely when creating an account. The information you provide will be handled in accordance with the Delta Cart privacy policy available at https://deltacart.com/privacy-policy. Should a participant lose employment from a participating company for any reason, that participant will no longer be eligible for participation in the DCCPP and must inform Delta Cart of their change in status.


For Personal Use Only


Participants in the DCCPP are eligible to purchase products from Delta Cart at a predetermined discount. All purchases done through this program must be for personal use only. Participants in the DCCPP are not permitted to resell any products purchased from Delta Cart. We may refuse to sell to you or terminate your account if we believe you are purchasing products to resell.


Ineligibility for Other Discounts or Promotions


Participants in the DCCPP are given specific discounts and benefits based on their employment in participating companies by agreement with Delta Cart. Participants may not combine DCCPP discounts or promotions with other discounts, promotions or other benefits available to other customers of Delta Cart. Participants may not be eligible to participate in Delta Carts’ Rewards Program.


Changes to Program


Delta Cart has the right to change the rules of the DCCPP at any time and for any reason or no reason. Changes may include limits on order size or frequency, the addition or removal of benefits such as free shipping, eligibility in other Delta Cart programs such as our Rewards Program, and other rules.
